Civil Status Regulations of the Municipality of Geldrop-Mierlo

The College of Mayor and Aldermen of the Municipality of Geldrop-Mierlo;

Whereas, the City Council has decided to delegate to their college the power referred to in article 147, second paragraph, in conjunction with article 108, first paragraph, of the Municipal Law to designate a town hall, as referred to in article 1:63 of the Civil Code;

Having regard to the provisions of Articles 1:16 to 1:16d of the Civil Code, Articles 1 to 5 of the Civil Status Decree and Articles 4 and 5 of the Civil Status Rights Act;

decision to adopt:

  • The Regulations on Civil Status of the Municipality of Geldrop-Mierlo 2025.

Article 1. Definitions

The regulations mean 

a. Law: Book 1 of the Civil Code; 

b. The Decree: Civil Status Decree 1994;

c. Civil Status Officer (Abs): a civil servant employed by the municipality and appointed as such by the Board of Mayor and Aldermen (Article 1:16, paragraphs 2 and 3 of the Civil Code) and sworn in by the court (Article 1:16, paragraph 4);

d. Extraordinary registrar of civil status (Babs): a person appointed as such by the college (Article 1:16, paragraphs 2 and 3 of the Civil Code) and sworn in by the court (Article 1:16, paragraph 4);

e. Marriage/Marriage: a consummation of a marriage, a partnership registration or a conversion of a registered partnership into a marriage.

f. Conversion: the conversion of a partnership into a marriage.

g. Parties: legal term for participants in the process marriage 

h. Town Hall: all buildings designated as such by College resolution. 

Article 2. Civil registry official

1. The college may appoint as registrar of civil status officials employed by the municipality, working in the Public Affairs team. A registrar of births, marriages and deaths cannot perform his or her duties until he or she has been sworn in at the court for this purpose. The appointment ends when the official is no longer employed by team Public Affairs.

2. The minimum number of designated civil registrars shall be two.

Article 3. Extraordinary registrar of civil status

An Extraordinary Registrar of Civil Status is appointed by the college and can perform his duties only after being sworn in at the court for this purpose. 

The municipality of Geldrop-Mierlo has 2 types of Extraordinary Officials of Civil Status.

3.1 Paid Extraordinary Registrar.

         a. A paid Babs has an employment contract with the Municipality of Geldrop-Mierlo and performs the task of performing marriages. 

         b. The registrar and extraordinary registrar shall be appointed for a period of time, to be determined in the decision to appoint.

3.2 Unpaid Extraordinary Registrar.

The unpaid Babs may also be a person who is not an official in municipal service. Unpaid Babs may be designated:

1. members of the college, for the term that one is named as a college member and holds that position;

2. an (extraordinary) civil registrar appointed in a municipality other than the municipality of Geldrop-Mierlo and employed as such by the municipality in question, who is appointed for one day at the request of the bridal couple or registering partners.

Article 4. Discrimination

The (extraordinary) civil registrars to be appointed by the college, shall perform all lawful marriages, making no distinction on the basis of religion, belief, political affiliation, race, sex or on any ground whatsoever.

Article 5. Procedure for appointing Babs for one day

1. The appointment of an unpaid special registrar for one day shall be made only after the bride or groom or the registering partners have indicated that they wish to have that person as a special registrar. 

2. The written or electronic request for this purpose shall be made stating 

         a. the names, address and telephone number of the bridal couple or partners, as well as the intended Babs for one day, 

         b. the date and time and address of the venue, 

         at least 1 month before the date of the wedding.

3. The request shall be addressed to the Public Affairs team manager.

4. The request shall be accompanied by the submission of the proposed extraordinary registrar:

         a. a copy of a valid identification document

         b. the designation decision of the municipality where one was appointed

         c. an employer's statement showing that one is still employed in the municipality where the designation decision was made

         d. the audience sheet of the swearing-in by the Court.

5. An extraordinary civil registrar appointed for one day, shall on the day of the marriage ceremony have the accompaniment of a civil servant of the Municipality of Geldrop-Mierlo. 

Article 6. Town hall designation 

1. Designated as permanent locations as town halls are the Villa in Geldrop and the Old Town Hall in Mierlo.

2. The Requirements that must be met in order to grant the request for the (one-time) designation of a town hall for marriage are:

         a. Written request, using the appropriate form;

         b. The said form must be signed by the manager/owner of the venue in question and the wedding parties;

         c. Upon consideration of the request for designation of a town hall, a fee shall be charged for the performance of work in connection therewith. These fees will also be charged if the request is denied. These dues are established by dues decree. 

         d. The site must meet the specified Requirements, see Appendix 3.

         e. The Municipality shall not be liable for any damages, however named, suffered by the parties as a result of or in connection with the use of the designated site. The parties shall indemnify the Municipality against claims for compensation for damages incurred as a result of or in connection with the parties' use of the designated site.

         f. When marrying outside the permanently designated locations, an official must be present at all times. This official will ultimately decide on the day of the wedding whether the location in question has fulfilled all agreements as set forth in the agreement. 

         g. In any case, permission will not be granted for marriage in the following venues:

                - hot-air balloon

                - squat

                - coffee shop

                - stages, squares or parks or other outdoor public places, subject to exceptions.

3. The said form referred to in paragraph 2(a) is annexed to these regulations.

Article 7. Management of the service

The Public Affairs team manager is in charge of the civil registry office. In his absence, he is replaced by the Public Affairs Policy Officer.

Article 8. Free marriage 

1. Complimentary realization of a marriage takes place on Thursday mornings at 09.00 and 09.15 a.m. at the registry office of the town hall, de Meent 2 in Geldrop. This ceremony is limited to the saying of the legally required yes and the reading and signing of the deed in the presence of the bride and groom and the witnesses. This ceremony lasts a maximum of 10 minutes and there is no choice of registrar. 

2. A maximum of 6 people can attend the wedding, including bride and groom and witnesses.

3. Appointments for free wedding are possible as far as the calendar allows.

4. At least one person of the bridal couple or partners must be registered in the Basic Registration of Persons of the municipality of Geldrop-Mierlo. This applies both during booking and on the date of the wedding ceremony. 

5. If Thursday is a nationally recognized holiday, a free wedding is not possible.

Article 9. Marriage reduced rate

1. Weddings are available at reduced rates on Thursday mornings at 9 a.m. and at 9:30 a.m.

2. The ceremony:

         a. takes place in the villa of the municipality of Geldrop-Mierlo.

         b. is limited to performing the legal formalities, where no choice of BABS can be made.

         c. lasts a maximum of 15 minutes

         d. takes place with up to 20 people, including bride and groom and witnesses.

3. If Thursday is a nationally recognized holiday, a reduced-rate wedding is not possible.

Article 10. Opening

1. The registrar's office is open to the public Monday through Thursday from 9 a.m. to 5 p.m. and Friday from 9 a.m. to 12:30 p.m.

2. It is possible to have a marriage performed on a Friday afternoon, weekend, holiday or evening when an officiant is available.

3. The wedding ceremony lasts a maximum of half an hour and takes place on the whole hour.

4. The civil registry office is closed if the opening established in paragraph 1 coincides with generally recognized or equivalent holidays within the meaning of Article 3 of the General Deadlines Act or other days designated by the Board on which the office is not open or is only partially open. 

5. In special cases, the College or the officials referred to in Article 7 may decide to deviate from the hours specified in the first paragraph.

Article 11. Fees

1. Fees are charged for getting married. In case of cancellation of a made wedding appointment, dues will be charged. 

2. Fees shall be charged for the appointment of an unpaid extraordinary civil registrar mentioned in Article 3, paragraph 3. 

3. For making changes to the reservation, of date, time and witnesses, for example, fees will be charged.

4. For converting a registered partnership into a marriage at the counter, fees are charged.

5. The fees referred to in paragraphs 1 through 4 shall be established by a fee resolution. 

Article 12. Final Provisions

1. The regulations may be referred to as Reglement Burgerlijke Stand Geldrop-Mierlo 2025 and shall enter into force on the day following the day of publication.

2. The Civil Status Regulations Geldrop-Mierlo 2019 shall be repealed as of the day these Regulations enter into force.

APPENDIX 1

AGREEMENT DESIGNATION PERMANENT WEDDING LOCATION FOR PERFORMING A MARRIAGE OR REGISTERING A PARTNERSHIP WITHIN THE MUNICIPALITY OF GELDROP-MIERLO

Definition: In this agreement, " marry" means to enter into a marriage or register a partnership.

The undersigned:

a. hereinafter referred to as "administrator"

and

b. The Municipality of Geldrop-Mierlo, validly represented by the Manager Team Publiekszaken, hereinafter referred to as "the Municipality",

considering that:

1. the civil registry regulations apply,

2. the administrator agrees to provide the municipality with the requested location for marriage,

3. the parties wish to set forth the Requirements and Requirements of the foregoing as follows,

declare to have agreed:

  1. The above is part of this agreement.

2. As of the signing of this agreement, the Administrator shall provide to the Municipality, free of charge, the requested location for a period of one year and shall grant the Municipality permission to use such space(s) for the purpose of marriage. After the expiration of one year from the signing of this agreement, an evaluation/assessment will take place, after which, based on the findings, this agreement will or will not be renewed for another year.

3. The municipality takes care of all formal aspects associated with getting married.

4. Upon request, the administrator shall grant prospective bridal couples or partners the opportunity to visit the room(s) by appointment.

5. The municipality manages the calendar regarding the setting of the wedding date and time of marriage. 

6. Once the wedding date and time, stated under 5, are fixed, both the administrator and parties involved cannot deviate from them. Unless there is force majeure, a cancellation/change will incur costs.

7. The municipality reserves the right to suspend the wedding venue in the event of special circumstances.

8. The Manager agrees that the Municipality of Geldrop-Mierlo is not liable for any injury, however called and including legal liability, to or on account of persons present and/or damage, however called, to the premises and/or interior. 

9. The administrator may be required to provide a VOG.

10. The administrator shall inform the municipality of relevant changes.

APPENDIX 2

AGREEMENT DESIGNATION WEDDING LOCATION FOR ONE DAY TO PERFORM A MARRIAGE OR REGISTER A PARTNERSHIP WITHIN THE MUNICIPALITY OF GELDROP-MIERLO

Definition: In this agreement, " marry" means to enter into a marriage or register a partnership

The undersigned:

a. hereinafter referred to as "administrator" and

b. The Municipality of Geldrop-Mierlo, validly represented by the Head of Public Affairs, hereinafter referred to as "the Municipality," considering that:

1. the civil registry regulations apply,

2. the administrator agrees to provide the congregation with the space described in Appendix 1 for marriages

3. the parties wish to set forth the Requirements and Contents of the foregoing as follows, declare that they have agreed:

1. The foregoing is made a part of this Agreement.

2. On __-__-____, the Administrator shall make available to the Municipality once free of charge, the space(s) described in Appendix 1 and shall grant the Municipality permission to use such space(s) for marrying parties:

3. The municipality takes care of all formal aspects associated with getting married.

4. The manager of the one-day venue shall, upon request, provide prospective brides and grooms the opportunity to visit the room(s) by appointment.

5. The municipality manages the calendar regarding the setting of the wedding date and time of marriage. 

6. Once the wedding date and time, stated under 5, are fixed, both the administrator and parties involved cannot deviate from them. Unless there is force majeure, a cancellation/change will incur costs.

7. The manager of the one-day venue agrees that the Municipality of Geldrop-Mierlo is not liable for any injury, however called and including legal liability, to or on account of persons present and/or damage, however called, to the premises and/or interior. 

8. The manager has reported the presence of 50 persons or more in the relevant one-day venue, where there is no pre-existing permit for this purpose, to the Municipal Support Team.

9. The manager has reported the presence of 50 persons or more in the relevant one-day venue, which does involve a pre-existing permit for this purpose, to the Municipal Support Team.

10. This agreement is valid for one day, namely __-__-____.

Appendix 3

Requirements designation of one-time or permanent wedding location

Location:

1. Must be within the municipal boundaries of the municipality of Geldrop-Mierlo;

2. An outdoor location is possible, provided that a fallback location (=building) is established in the immediate vicinity (so-called bad weather provision).

3. May be a vessel, with the Requirements that the marriage is performed in a closed compartment, the vessel is within the municipal limits and moored at a wharf.

4. Must be suitable for a "dignified" marriage ceremony where it does not violate public order and morals or honor.

5. Must, where appropriate, be equipped with a sound system and microphone to enable the (Extraordinary) Official of the Civil Registry to intelligibly deliver the speech;

6. Must have adequate lighting and heating, where appropriate;

7. Must be structurally sound and clean;

8. Must be freely accessible in a simple manner and, to the extent possible, for the disabled.

9. Must be publicly accessible.

10. May not interfere with the orderly conduct of the marriage ceremony and its requirements under the law.

11. Must provide free passage for all emergency services in all circumstances;

12. Must provide adequate space for the number of expected persons who will attend the ceremony.

13. Must meet the requirement of mandatory notification if 50 or more persons will be present at the location in question. The hospitality industry is exempt from this. If applicable, a notification of this must be made 4 weeks prior to the ceremony to team Support of the municipality;

14. Must be an appropriate setting for the ceremony, with the administrator responsible for the overall entourage, including furnishings and decorations thereof. Costs shall be the responsibility of the administrator;

15. Must have adequate parking in the vicinity for the (Extraordinary) Civil Status Officer.

16. Must have a toilet facility and changing area, a table and sufficient chairs for the (Extraordinary) Registrar and parties and sufficient chairs for guests.
