What does the Omgevingswet entail?
The Omgevingswet combines and improves all 26 laws dealing with the physical environment into one law. These are laws that deal with everything you hear, see and smell in your environment. Think of noise, soil, nature, traffic, air, water, heritage, construction and land matters.
A lot is changing with the introduction of the law. We list the most important changes and new terms:
- All our policies are now in one environmental vision and a number of programs;
- All zoning plans are now in one Environmental Plan;
- We consider whether an application fits in with the environment and meets the needs of residents. And also pay attention to the impact on health, safety and the environment;
- A permit application that deviates from the environmental plan is now called: Out-of-plan environment plan activity (abbreviated: BOPA). Permit applications will be processed as Opa (Ambient Plan Activity) or Bopa (Off-plan Ambient Plan Activity).
The Omgevingswet will be easier to consult because there are fewer rules and they are all in one place in the Omgevingsloket. The development of the new omgevingsloket (also called DSO) is a complex operation. It is not expected to be complete by the time the law takes effect.
