Status of plan distribution center Eeneind-West in Nuenen
Interested parties and non-interested parties who submitted views can still appeal the decision of B&W Nuenen until June 23, 2025.
The college of mayor and aldermen of the municipality of Nuenen c.a. announced a few weeks back that it has granted the requested permit for the construction of a distribution center on Eeneind-West. You can still find the decision of the Nuenen Board of Mayor and Aldermen and its explanatory statement on the website of the Municipality of Nuenen. Now that the Municipal Executive of Nuenen sees insufficient evidence in the views and has proceeded to grant a permit, it is possible for interested parties and also non-interested parties who have submitted a view to appeal until June 23, 2025. The judge will look at the case and must rule within a reasonable period of time. For the appeal phase, that time limit is 18 months. If a party to the appeal would not agree with the court ruling, they can appeal. Then the case goes to a higher court, namely the Administrative Law Division of the Council of State. An appeal must be filed within six weeks of the ruling being sent.
Pro forma appeal
Appeals must be filed with the East Brabant District Court no later than June 23, 2025. At that time, you may not have been able to put on paper all the arguments why you do not agree with the decision to grant a permit for the distribution centers. In that case, it is possible to file a "pro forma" appeal. This means that you file an appeal with the Court, letting it know which specifically named decision you disagree with, but that the reasons for it (the so-called "grounds of appeal") will still follow. You ask the Court for an additional period of time to supplement your appeal with the grounds of appeal. The court determines the time limit you will be given, but as a rule, the court grants a four-week period for this purpose.
Appeal college of mayor and aldermen of Geldrop-Mierlo
The Board of Mayor and Aldermen of the Municipality of Geldrop-Mierlo finds it particularly regrettable that the Board of Mayor and Aldermen of Nuenen has not found an opportunity to abandon its intention to grant this permit because of the far-reaching consequences this plan will have, according to the Board of Mayor and Aldermen of Geldrop-Mierlo. The building of the distribution centers will cause an enormous increase of (freight) traffic in our municipality with all its consequences, according to the Municipal Executive of Geldrop-Mierlo. Many traffic jams and even unsafe situations are expected at locations where it is already extremely busy. Think of the traffic circle at the Bogardeind with the entrance and exit of the A67. In addition, the air quality will deteriorate and it is possible that increasing congestion will jeopardize the response times of emergency workers.
Reasons enough to appeal the decision of the College of Mayor and Aldermen of the Municipality of Nuenen also on behalf of the College of Mayor and Aldermen of Geldrop-Mierlo and by unanimous order of the Municipal Council of Geldrop-Mierlo.
