Denial of paternity by mother
What is it?
As a mother, you can deny that your deceased husband is the child's father. To do this, you must make a statement to the municipality. You can do this if these 2 points apply:
- Your spouse died within 306 days before the child's birth.
- You were living separately from your spouse as of the 306th day before the birth or you were legally separated as of that day.
Even in other situations, you can sometimes deny paternity. You must then file a petition with the court.
In lesbian couples, the partner becomes the child's duo-parent. The child must then have been conceived by artificial insemination using an anonymous sperm donor. If the duo-parent plays no role in the care or upbringing of the child, she can apply for denial of parenthood
