The college of mayor and aldermen of the municipality of Nuenen c.a. has announced that it has granted the requested permit for the construction of a distribution center on Eeneind-West.

Until June 23 it is possible to submit an appeal against this decision to the District Court Oost-Brabant. In addition, the air quality is deteriorating and it is possible that the response times of emergency workers will be compromised by increasing congestion. Reasons enough to lodge an appeal against the decision of the Municipal Executive of the Municipality of Nuenen on behalf of the Municipal Executive of Geldrop-Mierlo and by unanimous order of the Municipal Council of Geldrop-Mierlo. Stakeholders and non-stakeholders also have option to appeal
Now that the Municipal Executive of Nuenen sees insufficient evidence in the views and has proceeded to grant the permit, it is possible for interested parties and also non-interested parties who have submitted a view to appeal. This must be done within six weeks of the announcement of the permit. The court looks at the case and must rule within a reasonable period of time. For the appeal phase, that period is 18 months.
If a party to the appeal could not agree with the court ruling, they can appeal. Then the case goes to a higher court, namely the Administrative Law Division of the Council of State. An appeal must be filed within six weeks of the ruling being sent.

Decision on environmental permit Eeneind-West and explanation college of mayor and aldermen of Nuenen:'On May 12, 2025, the Municipal Executive of Nuenen took a decision on the permit application for the construction of a distribution center on Eeneind-West. The college tested the application against the applicable zoning plan, and also carefully assessed the more than 1,500 views submitted. On this basis, the college could not decide otherwise than to grant the requested permit. Of course we understand the concerns of local residents that this decision raises. However, regulations in the Netherlands stipulate that a zoning plan is always leading in determining whether a permit must be granted. As a college we are obliged to check against the rules of the zoning plan.
